PRESENT WERE: Harold Thompson, Robert McCarthy, Steve Ross, Stephen Martino, Chris Kerr and Todd Machnik.
REGULAR MEETING
LOT LINE MODIFICATION – JUDGES FARM, LLC – OLD SHORE ROAD
Matthew White of Angus McDonald & Gary Sharpe & Associates presented the lot line revision. He stated the applicant would like to construct a green house and in order to meet the required setbacks they are proposing to swap a triangular piece of property (approximately 9,290 sq. ft) with the Martin Griswold property. He noted the division has been reviewed by Attorney Cassella. Thompson stated that in Attorney Cassella’s letter to the commission dated October 13, 2011 he requested that a zoning table be included showing that the Lot Line Modification will not create any nonconformities on these lots that do not currently exist. White stated that has been completed and shown on the revised plans dated 10/12/11. Thompson also read into the record the memo from Ann Brown dated
October 12, 2011. Thompson asked if the plan being presented was sufficient to address the concerns raised by Ann Brown. Kerr stated he felt the plan presented was more detailed than the Assessor’s Map. Machnik stated he felt it was an unnecessary burden on the applicant to show both lots in their entirety.
Steve Ross made a motion to approve the Lot Line Modification as presented. Chris Kerr seconded the motion. The motion passed unanimously.
DISCUSSION OF STATUTE CHANGES WITH REGARD TO SUBDIVISION BONDING
Thompson stated the commission received a memo from Attorney Cassella dated October 11, 2011 stating that October 1, 2011 the Legislature amended Section 8-25 of the General Statutes which governs subdivision and, more particularly, bonding for subdivisions. Cassella stated as a result of this amendment several sections of the Old Lyme Subdivision Regulations need to be amended. He noted prior to the next meeting he will to draft up the necessary amendments for the Planning Commission’s consideration.

BATTALINO SUBDIVISION – 160 MILE CREEK ROAD – REQUEST FOR 90 DAY EXTENSION
Harold Thompson made a motion to grant a 90 day extension to file the mylars for the Battalino Subdivision. Robert McCarthy seconded the motion. The motion passed unanimously.
TOWN REPORT
Thompson noted that he has received the annual request from Michele Dickey for the Planning Commissions summary of activities for the past fiscal year for the Town Report. Thompson agreed to update the report. Ross wanted to be sure that the meeting time was updated.
READING AND APPROVAL OF THE SEPTEMBER MEETING MINUTES
Steve Ross made a motion to waive the reading and approve the minutes as submitted. Stephen Martino seconded the motion. The motion passed unanimously.
ANY OTHER BUSINESS
Abandonment of Seasonal Use under the Old Lyme Zoning Regulations
Thompson reported that Rob McCarthy and he attended the Zoning meeting. He also reported that the letter from the commission was read into the record. He noted the Zoning Commission passed the amendment with a 4 to 1 vote.
Improvements to the Sound View District Regulations
Steve Ross asked the commission members if they had any interest in looking at the existing regulations with regard to the Sound View Village District and making recommendations to the Zoning Commission that would allow more improvements to the area. A brief discussion followed but no motions were made.
